- The terms and conditions hereunder (“Terms of Use”) shall apply to the use of the website www.vendorpay.co.in, web application ‘Vendor Payments APP’ and any other allied pages, softwares, features, content or application services (“Platforms”) offered or operated by Candour Retail LLP (“Company”).
- Any person logging on to, or using or browsing any of the Platforms (even when such person does not avail of any services provided by the Company through the Platforms (“Services”) shall be a “User” (“You”) and shall be deemed to have read and unequivocally accepted and agreed to be bound by these Terms of Use (including the Privacy Policy uploaded to the website of the Company). These Terms of Use shall supplement, and not override the terms / conditions of any other specific written agreement for Services that the User and the Company may have entered into.
- If You do not agree to these Terms of Use in any manner, please terminate Your use of this website and the other Platforms. You shall be deemed to have accepted these Terms of Use irrespective of whether You are a registered member or visitor, and the Company shall have the ability to bind You to these Terms of Use.
- The ‘Privacy Policy’ is provided separately, but forms an integral part of Your use of the Platforms and should be read together with these Terms of Use. To the extent any of the provisions of these Terms of Use (including the Privacy Policy) are declared void or unenforceable under law, the rest of the provisions hereof shall continue as is, and shall be binding upon the User.
- Subject to these Terms of Use and the various policies of the Company, the Company offers the services set out in Schedule A hereto (as amended from time to time, at the sole discretion of the Company).
This End User Agreement (the “Agreement”) is made between you (the “User” or “You”) and Candour Retail LLP (hereinafter referred to as “Vendor Payments”), a private limited company having its registered office at 336, Iskon Mall, 150 Feet Ring Road, Rajkot - 360005. (“Vendor Payments”, “Us” or “We”, which term shall include its successors and permitted assigns). The User and Vendor Payments shall be collectively referred to as the “Parties” and individually as a “Party”.
You hereby consent to Vendor Payments being appointed as your authorized representative to receive your Credit Information from Experian for the purpose of providing digital payments services through “Vendor Payments (“End Use Purpose”) on ongoing basis for a period not exceeding a period of six (6) months.
BY EXECUTING THIS AGREEMENT / CONSENT FORM, YOU ARE EXPRESSLY AGREEING TO ACCESS THE EXPERIAN CREDIT INFORMATION REPORT AND CREDIT SCORE, AGGREGATE SCORES, INFERENCES, REFERENCES AND DETAILS (AS DEFINED BELOW)(TOGETHER REFERRED TO AS “CREDIT INFORMATION”). YOU HERE BY ALSO CONSENT TO SUCH CREDIT INFORMATION BEING PROVIDED BY EXPERIAN TO YOU AND THE CLIENT BY USING EXPERIAN TOOLS, ALGORITHMS AND DEVICES AND YOU HERE BY AGREE, ACKNOWLEDGE AND ACCEPT THE TERMS AND CONDITIONS SET FORTH HEREIN.
Refund Policy
- For the purpose of availing services offered by Vendor Payments, users may be charged a convenience fee. Such Fees will be communicated to the users at the time of making payment on the platform.
- All the Fees collected is non-refundable. Fees can be revised from time to time at the discretion of the company. It is hereby agreed and acknowledged by user that the Fees charged in respect of a commercial transaction that has been settled or completed shall not be returned or repaid by Vendor Payments to the user or any other person irrespective of the transaction being rejected, charged back, refunded or disputed
- In the event any tax such as GST or the like is chargeable by Vendor Payments
in accordance with any statutory laws with respect to Your use of
Services ("Taxes"), Vendor Payments will charge such taxes. User agree to pay
such Taxes in addition to the Fees.
- In the event of a chargeback, Vendor Payments will promptly assess the legitimacy of the claim. If the claim is deemed legitimate and settlement is not made to the end beneficiary, Vendor Payments will initiate a refund, in full or in part, based on its determination of the appropriate amount, at its discretion.
